This Privacy Policy describes how we manage and process personal information when we make available our services to customers and manage our business and other relationships (the “Services”) as well as when you use our website https://investorbootz.com (the “Website”), our cloud-based platform (the “Platform”), or otherwise communicate with us.

We are committed to ensuring the privacy, security, and integrity of the personal information that you share with us or that we otherwise collect as we provide our Website, our Platform, and these Services. As described more fully below, we use personal information to provide and coordinate Services, operate and improve our Website and Platform, communicate with users, analyze business operations, and for the other purposes described in this Privacy Policy. We do not sell personal information.

  1. Information We Collect

We may collect personal information directly from you, or we may collect personal information from third parties as we provide our Services.

To the extent applicable, we indicate when we need personal information and the consequences for failing to provide it. If you do not provide personal information when requested, we may not be able to provide our Services, if either the personal information is required to provide our Services, or alternatively, we are legally required to collect it.

Below is a description of the different types of personal and business information we process or manage and the sources from which we collect that information:

Inquiries and/or Messages: If you contact us through our Website or Platform, we will collect your name, email address, telephone number, inquiry or message, order and account information and details (if any), cookies/analytics information, general website and usage data, and any other information you voluntarily provide us through our Website and/or that we need to respond. If you contact us through the phone, email, SMS, or chat, we will collect your name, email address or telephone number, inquiry or message, and any other information you voluntarily provide us through your contact method and/or that we need to respond.

Account Profile Setup: If you set up a new account profile, we will collect your name, email address, telephone number, business or company name (if provided), and engagement information such as opens or clicks.

Prospective or Actual Customers: If you are a prospective or actual customer of our business, we will collect your name, email address, telephone number, company name (if any), order details, property address, scheduling and contact details, access instructions, and payment information. We also may collect general location/service area information, a signature, driver’s license/state ID information, insurance information, and licenses. Depending on the nature of the work ordered, we may collect Social Security numbers, tax identification numbers, banking information, trust documents, real estate documents, probate documents, death certificates, loan documents, title documents, court filings, property addresses, account login information, order history, or other personal information necessary to complete the requested service.

Contractors: If you are a Contractor, we will collect your name, email address, telephone number, company name (if any), and payment information. We also may collect general location/service area information, a signature, driver’s license/state ID information, insurance information, licenses, assignment history, and other information needed to administer your relationship with us. If you voluntarily enable Live Arrival Updates for an active assignment, we may also collect precise location information from your mobile device, location timestamps, and location-derived assignment status information, such as whether you are en-route or have arrived at the assignment location.


LIVE ARRIVAL UPDATES AND PRECISE LOCATION INFORMATION

InvestorBootz offers an optional feature known as “Live Arrival Updates” to assist with active assignment coordination and customer communications.

Voluntary Deactivation. Live Arrival Updates is enabled by default. A Contractor may choose whether to disable it from the active assignment screen in the Platform. A Contractor may accept, begin, perform, and complete an assignment without enabling Live Arrival Updates. InvestorBootz personnel cannot remotely activate location sharing on a Contractor’s device.

Information Collected. When a Contractor enables Live Arrival Updates, the Platform may collect precise location information from the Contractor’s mobile device, together with related timestamps and location-derived assignment status information, while the applicable assignment remains active.

Assignment-Specific Use. Location sharing is tied only to the assignment for which the Contractor enables the feature and does not carry over to another assignment. No reusable PIN or separate location-sharing credential is used.

Contractor Control and Automatic Shutoff. The Contractor may disable Live Arrival Updates through the Platform. Location sharing also automatically stops when the applicable assignment is marked complete, canceled, or otherwise closed.

Customer and On-Site Contact Visibility. Customers and authorized on-site contacts may receive assignment status information, such as confirmed, en route, on site, or complete, through the Platform or through optional email or SMS notifications. Customers and on-site contacts do not receive the Contractor’s precise coordinates, a live location map, or an estimated arrival time.

How Location Information Is Used. We may use precise location information and location-derived information to coordinate active assignments; provide assignment status updates and arrival confirmations; operate, maintain, troubleshoot, and improve Live Arrival Updates; assist with assignment-related support questions or disputes; analyze assignment timing, arrival patterns, Platform performance, and service reliability; generate aggregated or de-identified operational reports; detect misuse; protect the Platform; comply with legal obligations; and improve our Services and business operations.

Automated Decisions and Contractor Scoring. We do not currently use precise location information to make solely automated decisions regarding Contractor compensation, eligibility for assignments, account suspension, or termination.

Retention. We retain precise location information collected through Live Arrival Updates for six months after the applicable assignment is completed, canceled, or otherwise closed. The precise location information is automatically deleted at the end of that six-month period. Assignment status records, arrival confirmations, timestamps, communications, and other non-precise order information may be retained for a longer period as part of the applicable order history.


  1. Sensitive Personal Information

Depending on the nature of the Services or your relationship with us, we may collect certain information that may be considered sensitive personal information, including government identification information, financial account information, account credentials, documents provided in connection with requested Services, and precise geolocation information. We collect precise geolocation information from Contractors only when they voluntarily enable Live Arrival Updates for an active assignment. We do not use precise geolocation information to infer a Contractor’s health, beliefs, personal characteristics, or other sensitive attributes, and we do not sell precise geolocation information. We do not intentionally request genetic data, biometric information used for identification, health information, information concerning sex life or sexual orientation, racial or ethnic origin, religious or philosophical beliefs, or union membership. We may nevertheless receive such information if it is voluntarily included in documents provided to us in connection with a requested Service.


  1. Cookies and other Technologies

We may collect personal information in the management and use of our Website and Platform.

For example, if you use our Website or Platform, we may collect the IP address of your computer and aggregate usage data on the browsing history, bounce rate, male vs. female, age range, desktop vs. mobile access, days of the week in which the Website or Platform is accessed and other usage data, including but not limited to browser type, pages viewed, length of time spent on the Website or Platform, in order to enable us to better manage Website or Platform traffic and to gather other analytics on the Website or Platform.

We may also use “cookies,” which are small data files placed and stored on your computer.  Cookies are used as follows:

(a) Utility Purposes: To enable our Website or Platform to function and manage each session use;

(b) Recognition Purposes: To recognize you as a returning user;

(c) Identification Purposes: To remind us of who you are;

(d) Traffic Measurement Purposes: To measure traffic patterns for use as a research tool to understand how our Website or Platform users’ habits are similar or different from one another; and

(e) Research Purposes: To conduct research on our Website or Platform.

You can set your browser to notify you when you receive a cookie, in order to give you the chance to determine whether or not to accept it.  If you do not accept cookies, some pages of the Website or Platform may not display properly.

These technologies help us operate and secure our Website and Platform, analyze usage, improve performance, and, where applicable, support our marketing and advertising activities.

We will use your personal information only for the purposes disclosed at the time of collection or as otherwise set out in this Privacy Policy, unless we have your consent or another use, or unless such other use is required by law.  The purposes which we use personal information, include the following:

Respond to Inquiries or Messages.  To respond to business, advertising, and prospective customer inquiries;

Provide and Coordinate Services.  To provide and coordinate Services to/for our customers;

Create Accounts.  To create accounts on our Platform;

Process Orders and Payments.  To process orders and payments for Services;

Relationship Management.  To manage our relationships with business contacts, prospective customers, customers, and contractors;

Communication.  To communicate with you and respond with an inquiry you make to us, and to communicate updates;

Provide Live Arrival Updates. To collect and process precise location information voluntarily provided by Contractors for active assignment coordination, status updates, and arrival confirmations;

Location-Based Operational Analytics. To analyze assignment timing, arrival patterns, Platform performance, and service reliability, and to create aggregated or de-identified operational reporting;

Assignment Support and Dispute Resolution. To investigate assignment-related questions, customer or Contractor support matters, suspected misuse, or disputes;

Manage and Improve our Website.  To manage and generate analytics for the improvement of our Website;

Manage and Improve our Marketing and Advertising.  To manage and generate analytics for the improvement of our marketing and advertising;

Improve Business Operations.  To administer, maintain, manage, and improve our business operations;

Collect Accounts Receivables.  To collect our unpaid accounts receivables, if any;

Legal Defense or Compliance.  To defend our legal rights or comply with our legal obligations;

Necessary Business Purposes.  For all other necessary business purposes; and

Other Legal Purposes.  As otherwise required by law.

We do not sell personal information. We may use personal information, including location-derived information, for the operational and analytics purposes described in this Privacy Policy. We do not currently use precise location information to make solely automated decisions that produce legal or similarly significant effects concerning Contractors.


  1. Disclosure of Personal Information

We may disclose personal information only as described below:

Provision of Services.  As necessary to perform Services on behalf of our Customers;

(b) Operation of Platform. As necessary to ensure the operation of the Platform on behalf of our Customers and Contractors;

(c) Delivery of Technical Support Services.  As necessary to provide technical support services on behalf of our Customers and Contractors.

(d) Payment Processing.  As necessary to process payments on behalf of Customers in order to pay Contractors.

(e) Collection of Accounts Receivables.  As necessary to service and collect our accounts receivables;

(f) Communication.  As necessary to communicate with and to our Customers, Contractors, third-party service providers, employees, and independent contractors, only as needed to manage our relationships with Customers, prospective customers, Contractors, employees, independent contractors, third-party service providers, and business contacts;

(g) Judicial Process.  If required by law, or if we believe that the disclosure is required or necessary to protect our rights and/or comply with a judicial proceeding or legal process service on us;

(h) Market and Sell to Prospects and Customers.  As necessary to market and sell Services to our Customers and prospective customers;

(i) Aggregate Analytics Data.  To our employees, independent contractors and third-party service providers, only as needed to understand how users use the Website and Platform;

(j) Legal, Accounting, and Compliance Advisors. As necessary to communicate and obtain services from our legal, accounting, and compliance advisors;

(k) Merger or Acquisition.  As part of the transaction in the case of a merger, sale or other asset transfer of our business, or if we are involved in any transaction in which we will not continue our business, or will be transitioning our Services to another firm;

(l) Compliance and Legal Necessity.  To address legal concerns or liabilities, respond to suspected illegal activity or fraud, defend against legal claims, or respond to a potential threat to the physical safety of a third party; and

(m) As Required by Law.  We may share personal information with third parties upon receipt of your consent as required by law.

(n) Assignment Status Information. We may disclose limited assignment status information and status notifications to the Customer who ordered the Service and to an authorized on-site contact associated with the assignment. Such recipients may receive statuses such as confirmed, en-route, on site, or complete, but they do not receive the Contractor’s precise coordinates, a live location map, or an estimated arrival time;

(o) Location Technology and Platform Service Providers. We may disclose precise location information to service providers that host, operate, secure, maintain, or support our Platform, location functionality, communications, and related infrastructure. Such disclosures are limited to the information reasonably necessary for those providers to perform services on our behalf;

Except as expressly stated above, we do not disclose personal information and we do

not share personal information to third parties for marketing and promotional purposes.

For the avoidance of doubt, we do not sell personal information to third parties.


  1. Sharing of Personal Information with Law Enforcement

Please be advised that we may be required to share personal information in response to lawful requests by public authorities, including but not limited to national security or law enforcement requirements.

Contractors may decline to enable Live Arrival Updates and may still accept, begin, perform, and complete assignments.

You have a right to request access to or the deletion of your personal information.  Please see “How to Submit a Verifiable Request” for further instructions on how to make your request.


  1. Your Rights with Respect to your Personal Information

Depending on your state or location of residence, you may have the following rights with respect to your personal information:

Disclosure: Right to request that we disclose personal information or categories of personal information that we collect, use, disclose, and sell; the purposes for which the categories of information collected by us are used; the sources of information from which we collect personal information; and the specific pieces of information we have collected on you;

Deletion: Right to request that we delete personal information we have collected from you;

Opt-Out: Right to request that we opt you out of the sale or disclosure of your personal information;

  1. Process Used To Verify A Request

If you make an access or a deletion request, you will be required to submit several identifying pieces of information including but not limited to your name, address, and phone number. We will use this information to search our systems and determine if we have information about you.  If we are able to locate information about you, we will fulfill your request.  If we are not able to match all three pieces of information you submit, we may provide you with a report that includes the categories of information we collect, use, disclose and sell.

If you are an authorized agent, you will be required to submit your name, address, and phone number, as well as the name, address, and phone number of the person on whose behalf you are making a request.  If we are able to locate the information about the person on whose behalf you are making the request, we will fulfill your request.  As an authorized agent, you will also be required to complete a form certifying you have the right to make this request on behalf of the third party.

We may utilize third-party service providers that perform services on our behalf, including Platform development and hosting, data storage, communications, payment processing, technical support, security, and location-data processing. These providers may access personal information only as reasonably necessary to provide services to us and are expected to protect the information in accordance with applicable contractual and legal obligations.


  1. Nevada Residents

Nevada law gives Nevada consumers the right to request that a company not sell their personal information for monetary consideration to certain other parties.  The right applies even if their personal information is not currently being sold. If you are a Nevada consumer and wish to exercise this right, please submit your request to us by sending an email request to David Queen at support@investorbootz.com or +1-800-544-9993.  You also may make a request in writing to the mailing address provided in Section 22 below.


  1. European Union Residents

If you are a resident of the European Union, you have additional rights with respect to your personal information:

Correction Right.  Right to correct any personal information that we have collected that is inaccurate or incorrect;

Right to Object.  Right to object to our continued storage, use or sharing of your personal information; and

Right to Withdraw Consent. Right to withdraw consent to our communications with you.

  1. Children's Information

Our Services are not directed to or intended for children under the age of eighteen (18), and we do not knowingly or intentionally collect personal information from children.   If you learn that your child has provided us with personal information without your consent, you may contact us as provided in Section 22 below.  If we learn that we have collected any personal information in violation of applicable law, we will promptly delete such information.

  1. Data Transfer, Storage & Processing

If you are accessing our Website or Services from Canada, the United Kingdom, Australia, the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure that differ from United States laws, please be advised that your personal information will be transferred to, stored, and processed in the United States.  We take steps to ensure that the service providers that we work with utilize industry best practices for maintaining data privacy and security.

If we are transferring personal information out of the European Union, please be advised that we will take such measures as are necessary to ensure that any transfer is in compliance with the EU General Data Protection Regulation (Regulation 2016/679 also known as the “GDPR”), including but not limited to transferring the personal data to a recipient in the United States that has executed standard contractual clauses adopted or approved by the European Commission and has certified under the EU-US Data Privacy Framework (“DPF”) Program. We acknowledge and agree that we are liable for all onward data transfers.

Our Website may link to other websites maintained by third parties.  Any such third-party websites will employ their own privacy practices and be subject to their own privacy policies.  We are not responsible for the policies or privacy practices of third-party websites.

We have implemented commercially reasonable security measures and follow generally accepted industry standards to protect all personal information in our possession, which includes employing commercially reasonable administrative, physical, and technical safeguards to maintain the confidentiality and security of all personal information.

To protect the information delivered to us, we secure our Platform with password-protected systems, two-factor authentication, limited access based on roles, internal controls, and vendor-service provider agreements.  We also employ payment processors rather than storing credit card data directly.

Although we strive to protect your personal information, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. Although we make every effort to protect personal information, we cannot guarantee its absolute security.

  1. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including providing Services, maintaining order and account history, processing payments, meeting accounting and legal obligations, resolving disputes, preventing fraud, protecting the Platform, and establishing, exercising, or defending legal claims.

Precise location information collected through Live Arrival Updates is retained for six months after the applicable assignment is completed, canceled, or otherwise closed and is automatically deleted at the end of that six-month period.

Location-derived assignment status records, arrival confirmations, timestamps, communications, and other non-precise order records may be retained for a longer period as part of the applicable order history.

Other categories of personal information are deleted, de-identified, or securely destroyed when they are no longer reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law.


  1. Changes & Updates To This Privacy Policy

We may amend this Privacy Policy at any time at our sole discretion and without prior notice.  If we make any material amendments, we will advise you about those changes by notifying you in a prominent place on each Website.  You should check back with us from time to time in order to confirm that there have been no significant changes.

Please note that the use of information that we gather is subject to the Privacy Policy then in effect at the time of use.
